Service agreement and terms for Jansen Flooring projects in New Zealand

1. Service Agreement

These terms and conditions ("Terms") govern your use of Jansen Flooring services and constitute a binding agreement between you ("Customer") and Jansen Flooring ("Company", "we", "us").

By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Services Provided

Jansen Flooring provides:

  • Commercial and residential flooring installation
  • Vinyl, carpet, laminate, and SPC flooring solutions
  • Anti-slip safety systems
  • Mobile showroom consultations
  • Flooring maintenance and repair services

3. Quotations and Pricing

All quotations are valid for 30 days from the date of issue unless otherwise specified. Prices are inclusive of GST where applicable.

Quotations are based on site measurements and specifications provided. Additional costs may apply for unforeseen site conditions or variations to the original scope.

4. Payment Terms

Payment terms are as follows:

  • Deposit: 50% required to confirm booking and order materials
  • Balance: Due upon completion of installation
  • Payment methods: Bank transfer, cash, or agreed payment plan
  • Late payment: Interest may be charged at 2% per month on overdue accounts

5. Warranties

Installation Warranty

We provide a lifetime warranty on our installation workmanship for the original purchaser, subject to normal use and proper maintenance.

Product Warranty

Products are covered by manufacturer warranties. We will assist with warranty claims as required.

Warranty Exclusions

  • Damage from misuse, negligence, or accidents
  • Normal wear and tear
  • Damage from flooding or excessive moisture
  • Modifications made by third parties

6. Liability Limitations

Our liability is limited to the repair or replacement of defective work or materials. We are not liable for consequential damages, loss of use, or indirect losses.

Total liability shall not exceed the value of the contract for the specific project.

7. Consumer Rights

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or other New Zealand consumer protection legislation.

For commercial premises, the Consumer Guarantees Act may not apply if the flooring is acquired for business purposes.

8. Cancellation Policy

Projects may be cancelled with written notice. Cancellation fees may apply based on:

  • Materials already ordered or delivered
  • Preparation work completed
  • Scheduling and administrative costs

9. Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic restrictions, or supply chain disruptions.

10. Dispute Resolution

Any disputes will be resolved through good faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of New Zealand courts.

For consumer matters, you may also contact the Disputes Tribunal or relevant consumer protection agencies.

11. Anti-Spam Protection

Our contact forms are protected by Google reCAPTCHA to prevent spam and automated abuse. By submitting a form on our website, you agree to Google's collection and use of data as described in their Privacy Policy and Terms of Service.
